Terms of Service
These Terms govern your use of the instruments operated by SUM 28 LLC (“Sum28”, “we”) — the website at sum28.com and our products p2d, ohm, and oak (each, a “Service”). By creating an account or using a Service, you agree to these Terms. If you are using a Service on behalf of a brokerage or firm, you agree on its behalf and confirm you are authorized to do so.
1 The instruments
p2d turns listing photos and your notes into listing copy, traced to evidence and screened for potentially problematic fair-housing language. ohm records open-house sign-ins and produces a seller’s report and, on request, property information for visitors. oak (planned for January 2027) will produce an annual statement for a home. Each artifact may carry the Sum28 seal, which links to the evidence and checks behind it.
2 Who may use the Services
The Services are intended for real-estate professionals and are not directed to children. You must be at least 18 and able to form a binding contract. You agree to provide accurate account information, to keep your credentials secure, and to be responsible for activity under your account. Open-house visitors who sign in through ohm are not required to hold an account; their use is governed by the notice shown at sign-in and by our Privacy Policy.
3 Your content and your responsibilities
You retain ownership of the photos, text, facts, and other materials you provide (“Your Content”). You grant Sum28 a limited license to process Your Content solely to operate and improve the Services as described in our Privacy Policy — never to train AI models and never to sell it. You represent that you have the rights to the materials you upload and the consents needed to collect and use any personal information they contain.
You are responsible for verifying output before you rely on or publish it. Our checks and fair-housing screening are automated assistance, not a legal determination.
4 The seal and our checks are assistance, not advice
Sum28’s grounding checks, verification, and fair-housing screening are designed to support your own review. They are not legal advice, not a compliance determination, and not an appraisal. Where we present a value, we present a range rather than a false point estimate, and a range is an estimate — not a guarantee. You, and where applicable your broker, remain solely responsible for compliance with all applicable laws, including the Fair Housing Act and state fair-housing laws, RESPA, the rules of the California Department of Real Estate (DRE), advertising and disclosure requirements, and CAN-SPAM and telephone/marketing consent laws.
5 ohm — open houses and consumer consent
If you use ohm to host an open house, you are the party with the relationship to the visitors and to the seller. You are responsible for using ohm honestly, for presenting the consent disclosure as provided, and for your own follow-up communications. Sum28 provides the instrument that records the sign-in and delivers the information a visitor requested; Sum28 does not represent any buyer or seller. You must not use ohm to collect information under false pretenses or to contact anyone who has opted out.
6 Acceptable use
You agree not to: use the Services to violate any law or third-party right; upload content you lack the rights to; attempt to defeat rate limits, security, or fraud controls; use the Services to send unsolicited bulk messages or to import purchased, rented, or scraped contact lists; reverse-engineer or resell the Services; or use output in a way that is deceptive or that misrepresents a property. We may suspend or terminate accounts that abuse the Services or put others at risk.
7 Payments, credits, and points
Paid features are billed through Stripe. Where a Service uses credits or points, those are a prepaid or promotional balance used within the Sum28 family of products. Unless stated otherwise at purchase or required by law: credits and points have no cash value, are non-transferable, and are not redeemable for cash or refundable as cash; they are not a stored-value or gift-card instrument. Prices, plans, and the credit/point model may change prospectively; we will not change them retroactively to your detriment. Applicable taxes may apply.
8 Intellectual property
The Services, the Sum28 and Σ28 marks, the seal, our software, and our verification methods are owned by Sum28 or its licensors and are protected by law. These Terms grant you a limited, non-exclusive, non-transferable license to use the Services; they grant you no rights in our marks or software beyond that use. Feedback you send us may be used to improve the Services without obligation to you.
9 Third-party services
The Services rely on third parties (including AWS, Anthropic, OpenAI, Stripe, and Apple). Your use may also be subject to their terms. We are not responsible for third-party services we do not control, though we choose vendors that we believe meet appropriate standards.
10 Disclaimers
The services are provided “as is” and “as available.” to the fullest extent permitted by law, sum28 disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and any warranty that output is accurate, complete, compliant, or fit to publish without your review.
11 Limitation of liability
To the fullest extent permitted by law, sum28 will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill. sum28’s total liability for any claim relating to the services will not exceed the greater of the amounts you paid us for the service in the 12 months before the claim, or US $100.
12 Indemnification
You agree to indemnify and hold Sum28 harmless from claims arising out of Your Content, your use of the Services, your communications with consumers or clients, or your violation of these Terms or of applicable law — including fair-housing, advertising, privacy, and marketing-consent laws.
13 Termination
You may stop using the Services and delete your account at any time (in p2d, Account → Delete account). We may suspend or terminate access for violation of these Terms or to protect the Services or others. Sections that by their nature should survive termination — including content licenses you granted, disclaimers, limitation of liability, indemnification, and governing law — survive.
14 Governing law and disputes
These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. The state and federal courts located in California will have exclusive jurisdiction, and you consent to venue there, except where applicable law provides otherwise. If any provision is found unenforceable, the rest remains in effect.
15 Changes to these Terms
We may update these Terms as the Services evolve — notably before oak launches and before ohm’s public launch. We will revise the “Effective” date and version above and, for material changes, provide notice through the affected Service. Continued use after a change means you accept the updated Terms.
